Now that cash bail has been eliminated in California in favor of “risk-assessment” a lot of questions about the new system are being raised.
How will the new system work? Will criminal defendants still be required to put up money? What happens to the bail bond industry?
When will the new law go into effect? Who will pay for it?
As with any new law, especially one as sweeping as this, a lot remains to be answered.
The state Judicial Commission will develop the risk-based assessment guidelines but it will be up to each county to create its own system.
